This details the nonfeasance on behalf of Officer Asuncion
regarding my request for aid.
When asked to help obtain my property
after I had located it, Officer Asuncion stated NO
and if he finds me in violation of the law, then he would have me
arrested. He didn't tell me that he was one of the officers who was also
involved in a high speed pursuit with my vehicle back in September '05.
October
22, 2005, two Kauai Police Officers come to my house to discuss the
ownership of Vehicle KTN 010, a 1980 brown Datsun station wagon. Their
reports were filed and their incident number recorded as noted below.

These officers tell me that they were involved in a high-speed chase with
the car I was the legal owner of back in September 2005. They told me
that I should get possession of the vehicle before it should cause property
damage or worse. They did not tell me that Asuncion had also assisted in
this pursuit.
I immediately set out to search for the vehicle. By
evening, I knew who had the vehicle.
October 23 2005 07:25
While searching for the car, I was stopped at Koloa School, fronting Paanau
Rd. I was on the phone with KPD dispatch at approximately 07:25, the same
time when I saw Officer Gilbert Asuncion heading out off Paanau towards
Poipu Rd. when I flagged him into the parking lot to ask for to ask for his
assistance with the Datsun KTN 036 Brown 4 Door Station Wagon vehicle.
When asked to help obtain my property, Officer Asuncion stated NO, and if

In report 27805, there are few instances of my vehicle being
referenced
by Officer Asuncion and the alleged victims Oct 23, 2005 that my vehicle is
oxidized green. Officer Asuncion also says I was in front of the school in
the ranger. This is not true as I was in Rosalind's F150 the morning of
October 23, 2005. We use the bigger truck to go to and from storage, to the
refuse station and to Home Depot.
The parking complaint was issued 9/29/05. It was issued to me as it has my
name and license number on it. I was not the person who had parked it there.
This citation does not end up in my record. It ends up on Rosalind's record.
The citation does not even have her Drivers License number on it. Why
was this change made?
It was submitted to the Courts November 10, 2005 and entered into the Court
system 11/29/05.
I explained him of how I gave the KTN 010 vehicle to my friend’s son 3 years ago and
I told him who has the vehicle currently, Josh Sesco, who currently works at
Koloa Big Save. We discussed the legalities, and my responsibilities for
being the legal owner. I told him that officers came to my house the day
before and had instructed me to go obtain possession of the vehicle.
I asked him why officers never impounded this car when they found it
abandoned in Kiahuna after being chased by officers back in September. I asked him for his
help and indicated I would like him to flatten the tires if he should come
across it and call me on the numbers I had just given him. That is where he
got the numbers for report 27805. I gave him my cell number and house number
in case he might run across it, he wrote it down on a paper he had in his
vehicle. He informed me that if I try to take the vehicle or flat the
vehicles tires and if he determines I am found to be breaking the law then
he would have me arrested. I asked him how can he arrest the registered owner
but he won’t help me gain possession of the vehicle and get it off the road.
I thought this to be an odd statement form someone sworn to protect and
serve and since I was the legal owner of the vehicle, it only caused me to
go to DMV to resolve it there. I was deeply confused about his comment to me
threatening to arrest me for taking legal possession of my own property.
Officer Asuncion does not tell me that he was one of the officers involved
the high speed pursuit

had not told me this until later in late October or early November of 2005.
What happens next is a course of events that lead to me being arrested for

Officer Asuncion takes the initiative to
charge me with this crime despite not doing an investigation. His motive?
To humiliate me, to discredit my name in the community? To act as both
legislative and judicial bodies? His actions are treasonous to the
Constitution.
"Truth of course cannot be produced
rapidly enough or effectively enough to immediately solve problems. So
action needs to be taken to prevent injustices. To not prevent injustices is
to be responsible for the cause. But it is important to understand the
difference between preventing injustice and retaliation. Retaliation does
not prevent anything.
Preventing injustices could be called police
action. Police are not supposed to retaliate. Describing how police should
prevent injustices goes beyond the purpose of this here. There is no perfect
way to produce force. Police action is a compromise in a corrupt environment
where good and evil interact. It is not a part of moral existence in the
absence of sin. Certainly, there are right ways and wrong ways for police to
